TERMS AND CONDITIONS
CLAUSE 1. GENERAL TERMS AND CONDITIONS. ACCEPTANCE.
1.1. These General Terms and Conditions of Contract shall apply to the sale of tickets and the use of products and/or services of the Mallorca Live Festival, forming an integral part of the contract by which tickets to the aforementioned Festival are acquired.
1.2. The sale of tickets is expressly conditioned upon the acceptance of these terms and conditions, with the user declaring, by accepting them, to have read, understood, and expressly accepted them before completing the purchase process.
1.3. If any of the clauses and/or stipulations of these General Terms and Conditions of Contract are deemed null or unenforceable for any reason, the remaining clauses shall remain fully valid and in force.
CLAUSE 2. GENERAL INFORMATION.
Of the event organizer.
2.1. In compliance with the duty of information, users are informed that the promoter and, therefore, organizer of the event is the entity MALLORCA LIVE MUSIC, S.L., with its registered office at Calle Maquinaria, No. 4, 1st floor, Postal Code: 07011 (Palma de Mallorca), and provided with Tax ID No.: B-16968091.
2.2. Notwithstanding the foregoing, the user may contact the event organizer via the following email address: info@mallorcalivemusic.com, the telephone number 690991134, or the postal address indicated in the previous section.
Of the online distribution and payment platform.
2.3. The online distribution and payment platform is ENTRADAS EVENTIM SAU, with its registered office in Madrid, c/Serrano Anguita 8, 2nd left, and Tax ID No.: A-81933772.
2.4. For these purposes, the user is informed that when purchasing tickets or passes, they will be doing so through an external payment platform solely owned by the distribution platform and, therefore, entirely independent of the event promoter.
CLAUSE 3. TICKETS.
3.1. The official ticket sales channels for the Festival are:

3.2. The organization does not guarantee the authenticity of the ticket if it has not been purchased through the official channels mentioned above, and users may acquire duplicated or counterfeit tickets that would prevent access to the event. For these purposes, the user is informed that the organization carries out electronic validation of 100% of the tickets presented at the time of entry, prohibiting access to any person with a ticket that has been previously validated or purchased outside the official channels.
3.3. Any ticket showing signs of forgery will authorize the organizer to deny access to the venue to its holder. The resale of tickets is expressly prohibited. Any illegal practice involving the resale of tickets by the user will entitle the organizer to claim any legally applicable damages.
3.4. Once purchased, the user will receive an email with the acquired ticket. In case of any issue with the received email, the user must contact the sender, i.e., the distribution platform, via the following form: atencionalcliente@entradas.com.
3.5. The event promoter is not responsible in case of loss or theft of the ticket.
3.4. The user is permitted to upgrade the purchased ticket, with “upgrade” meaning the exchange for a higher-priced ticket, provided it is for the same event and the user pays the price difference. To carry out these upgrades, it will be necessary to first purchase the new ticket. Once acquired, the full refund of the original ticket amount will be processed to the bank account associated with the payment card. To do so, the user must provide all purchase details and the locators of both purchases by contacting the organizer via email, which must match the email address provided during the initial purchase.
3.4. Certain tickets are available at a discounted or special rate. The user purchasing a ticket with these characteristics must provide proof at the time of entry to the venue, along with the relevant documentation, to justify eligibility for the selected rate or discount. Otherwise, the applied discount will be deemed invalid, and it will be at the organizer’s discretion to deny access or allow entry upon payment of the difference between the discounted rate and the regular ticket price.
3.5. The official sales channels offer tickets for people with reduced mobility (PRM) and people with sensory diversity (PSD), located in specially designated areas of the venue. For this reason, access to any of the venue’s floor areas is not permitted with crutches, canes, wheelchairs, folding chairs, walkers, scooters, or any other support devices or similar characteristics.
CLAUSE 4. RIGHT OF WITHDRAWAL. CHANGES AND REFUNDS.
4.1. Once the ticket is purchased, the right of withdrawal will neither be applicable nor exercisable, as it pertains to a service related to a leisure activity with a specific execution date.
4.2. Notwithstanding the above, the user will be entitled to request a refund of the ticket amount in the following cases:
- Total cancellation of the event before its start.
- Significant modification of the lineup, understood as the cancellation of one or more main artists without the possibility of a comparable replacement.
- In cases of cancellation or significant modification of the event due to force majeure, the ticket amount will be refunded, except if the force majeure occurs once the event has started. In this latter case, no refund will be issued.
4.3. In case of cancellation or significant modification of the event by the organizer, the purchaser may request a refund within a period not exceeding fifteen days from the date of the public announcement of the cancellation, always presenting the proof of purchase.
4.4. The cancellation of events scheduled for one day will not necessarily entail the cancellation of the remaining days of the Festival. For this reason, the user may not request a refund for tickets corresponding to the days of the Festival that were able to take place.
4.5. Weather conditions that do not prevent the Festival from taking place will not entitle the user to a refund of the ticket. Extreme weather conditions likely to lead to cancellation are those that may prevent the Festival from being held and make it impossible to guarantee the safety of attendees and the staff responsible for setup.
4.6. In general, refunds will not be accepted in cases of the user’s inability to attend the event and/or errors made during the ticket purchase process.
CLAUSE 5. ACCESS TO THE VENUE.
5.1. Entry to the venue will require presenting the ticket to be scanned by security personnel. The ticket will be valid only for the day indicated on it.
5.2. For security or access control reasons, the user may also be required to present their national identity document (DNI) or any other official identification.
5.3. The entry and access of animals to the venue are prohibited, except for assistance dogs that have been individually trained to perform tasks for the benefit of people with physical, sensory, or intellectual disabilities.
5.4. The organization assumes no responsibility in case of loss or theft of the ticket.
5.5. The ticket holder is responsible in case of duplication of the ticket. It is the responsibility of the purchaser to safeguard the ticket and prevent it from being duplicated. It is recommended not to post the ticket on social media, not to print it in unsecured locations, and to keep it out of the reach of third parties.
5.6. Only the first ticket presented and validated at the festival entrance will be considered valid. Any ticket with the same code presented subsequently will be invalidated.
5.7. The organizer is entitled to deny access to the venue and expel the user from the venue if any of the following circumstances occur:
- The ticket is incomplete, damaged, or shows signs of forgery.
- The holder violates the instructions of the organizer or the organizer’s staff, such as the prohibition of access to restricted areas.
- The holder displays a violent attitude or publicly incites hatred, violence, or discrimination based on birth, race, sex, religion, opinion, disability, sexual orientation, gender identity, or any other social or personal condition or circumstance, and, in particular, to the holder who behaves aggressively or causes disturbances outside or at the entrance, carries weapons or objects that could be used as such, or wears clothing, objects, or symbols that incite violence or advocate activities contrary to the fundamental rights recognized by law and the Constitution.
- The holder is in possession of drugs, engages in drug trafficking, or shows signs of consuming or having consumed drugs or narcotic substances.
5.8. In any case, denial of access and subsequent expulsion from the venue will result in the non-refunded ticket amount, as well as the withdrawal of the payment wristband provided at the start of the event.
5.9. The exercise of the right of admission will not, under any circumstances, entail denial of access to the holder for reasons of birth, race, sex, religion, opinion, disability, sexual orientation, gender identity, or any other personal or social condition or circumstance.
5.10. Upon entering the venues, the public may be subject to a search in accordance with applicable regulations on public safety, public events, and recreational activities. The entry of objects deemed dangerous by the organization or prohibited by current regulations is not permitted.
5.11. Entry to the venue with food and beverages from outside is permitted, subject to the following conditions for the safety and hygiene of all attendees:
- Entry to the venue with one sandwich or similar (sandwich, snack) per ticketed user is permitted, except for foods that, during any inspection, are confirmed to pose a risk to other users due to their hazardous nature.
- In general, entry to the venue with food for medical purposes is permitted for users with diabetes, severe food allergies, or any other medical condition.
- Entry with baby food is permitted, provided it is properly sealed and identified.
- Entry to the event with pieces of fruit that, due to their weight and composition, could be thrown and cause harm to other users, as well as any other item that, due to its excessive weight and composition, could cause the aforementioned harm, is expressly prohibited.
- Entry with food in Tupperware containers, regardless of the material, that may pose a risk or danger to other users is expressly prohibited.
- Entry with portable coolers, food preservation items, cutlery, and similar utensils is expressly prohibited.
- Only non-alcoholic beverages in plastic bottles with a capacity of up to half a liter will be permitted. For safety reasons, the bottle cap must be removed to gain access to the venue.
5.12. Entry to the venue with one reusable cup per user is permitted, provided it meets the following specifications:
- Material: hard plastic. Glass cups are not accepted for safety reasons.
- Minimum capacity: 330 ml.
- Maximum capacity: 600 ml.
- Condition: The cup must be clean and in good condition without breaks or sharp edges.
5.13. The Festival organization reserves the right to deny entry to cups that do not meet the aforementioned conditions. Likewise, users are informed that they can purchase an official Festival reusable cup inside the venue for a price of €2. Additionally, if the user returns the cup in good condition to the designated points, the full amount paid will be refunded.
5.14. Access to the venue will only be authorized from the time indicated on the ticket until the end of the event.
5.15. The organizer may deny access or expel the ticket holder from the venues in case of non-compliance with the instructions of the organization’s staff, as well as if it can reasonably be presumed that a situation of risk or danger will arise for the holder or other attendees, or due to apparent or potential intoxication, with the holder being personally responsible in all cases for their own actions and omissions that cause harm to third parties or damage to property.
5.16. The user must retain their ticket until the end of the event, and the organizer may require its presentation to process any claims that may arise.
CLAUSE 6. EVENT PRODUCTS AND/OR SERVICES. PAYMENT METHODS.
In general
6.1. All users of the Mallorca Live Festival will be provided with an interactive wristband, which will grant access to a range of services within the venue.
6.2. Each interactive wristband is equipped with an RFID chip. With this chip, the organization offers users the possibility of accessing the following services:
- General RFID Services:
- Festival entry.
- Electronic payment service, loaded with cash or credit card at the festival.
- Optional RFID Services:
- Electronic payment service, loaded with a credit card on the website.
To access the “RFID Services,” the attendee must register their ticket through the “online registration service” available on the Festival’s website.
6.3. These General Conditions regulate the operation of the website service (mallorcalivefestival.com) and all its subpages (hereinafter “Website”), hosting the “online ticket registration service.” These General Conditions do not directly regulate the “RFID Services,” which are subject to the specific terms and conditions determined by the organization and/or third parties.
6.4. The term “Service” shall hereinafter refer to all visits and/or use of the “Website” (offering the “online wristband registration service”).
6.5. By using the Service, the user acknowledges having read and accepted these General Conditions.
Content, availability, use, and operation of the Basic Service.
6.6. Upon accessing the venue, the ticket will be exchanged for an RFID chip wristband that allows the use of general RFID Services.
6.7. In the basic mode, the wristband will operate solely as a virtual wallet within the venue and for access control. This wristband will be unique, non-transferable, and capable of offering the services described. Possession of this wristband only grants the user access to the services regulated by the organization and their inherent and natural alternatives.
6.8. The payment mechanism for all services available to the user within the Festival venue (drinks, food, merchandise, etc.) will be processed through the wristband and its payment protocols. Upon delivery of the wristband, it will be activated by the organization, and the user may load it with funds at the designated points within the venue.
6.9. The amounts or sums loaded onto the wristbands are non-transferable between different wristbands or users.
6.10. Tampering, alteration, or forgery of any wristband will result in its immediate withdrawal from the user, with no refund of any loaded and unspent amounts, and the immediate expulsion of the responsible party or possessor of said wristband(s).
6.11. In the basic wristband usage mode, no registration or verification of personal information is required, except for age in cases where the organization deems it necessary.
6.12. Upon entering the venue, receiving, and/or using the wristband, the user acknowledges and agrees to the terms, uses, and conditions of this document, adhering to them and their application.
Content, availability, use, and operation of the Full Service.
6.13. In the full mode, in addition to the same uses and services identified above, the user may utilize the options offered by the organization for users of wristbands who register on the organization’s website “mallorcalivefestival.com,” such as payments via bank account or credit/debit cards.
6.14. This registration must be carried out necessarily through and following the instructions of the website system, enabling the funding of wristbands, both for oneself and third parties, through bank transfers via the enabled payment gateways.
6.15. Account creation, ticket registration, and RFID Service activation.
To use the general RFID Services, the user must validate their ticket through the website and receive the wristband at their address or validate the ticket at the Festival venue in the validation area. There, the ticket is exchanged for an RFID chip wristband that allows the use of general RFID Services.
To use one or more optional RFID Services or the full package, the user must register and link their ticket on the official Festival website enabled for this purpose: mallorcalivefestival.com. On this page, the steps for registration, account creation, ticket registration, acceptance of personal data processing, RFID service activation, electronic payment service activation, and wristband funding via credit/debit card will be indicated.
To fully enable the functional capabilities of the wristband, the user must necessarily accept the applicable terms and conditions for the entire service at the time of registration on the website.
6.16. The Service may contain or refer to hyperlinks to other websites or third-party web pages. The organization does not control all content or other characteristics of these websites or web pages, and the organization is also not responsible for the content or characteristics of these websites or web pages. Even if the organization adds a hyperlink to another website or web page, this does not imply that the organization agrees with the content of that website or web page.
General Service Usage
6.17. Only those over 18 years of age are authorized to use the Service without supervision.
- The use of this service is at the user’s own risk.
- The user declares having read and accepted the following:
- The user is not authorized to copy, duplicate, reproduce, sell, resell, or exploit any part of the Service, use of the Service, or access to the Service.
- The user is not authorized to use any data collection methods, screen scraping, robots, or similar data collection or extraction methods.
- The user is not authorized to upload or transmit computer viruses, trojans, worms, or any other destructive elements.
- The user is not authorized to modify, adapt, hack the Service, or modify any third-party website to falsely imply that it is associated with the Service.
- The user is not authorized to attempt to effectively collect and/or use usernames, passwords, email addresses, or other personal data from the Service for any purpose.
- The user may not use the Service for any illegal or unauthorized purpose.
- The user may not violate any law through the use of the Service.
- The organization reserves the right to modify or temporarily or permanently suspend the Service or part of it, with or without notice and for any reason at any time.
Use of wristbands for minors.
6.18. All Festival attendees must wear an RFID wristband, which will serve as proof of entry and for capacity calculation purposes, regardless of the age of the holder.
6.19. Minors under 18 will be provided with a distinctive wristband that limits their ability to purchase alcoholic beverages.
6.20. Minors under 18 may only use the wristband services in basic mode, unable to expand the scope of the service through payments via cards or bank accounts in the full package.
6.21. Minors under 16 must be accompanied by a parent or legal guardian, who must fund or load the minors’ wristbands.
6.22. At the time of entry to the venue through the delivery or exchange of the ticket, minors must, under warning of being denied access to the Festival without refund of the ticket amount, provide the organization with a liability waiver document from the Festival, which can be accessed or downloaded from the official website or at the venue entrance.
Refund of remaining amounts.
6.23. No cash refunds will be made for remaining or residual balances on wristbands to users at the end of the Festival.
For the refund of remaining or residual balances on wristbands, the user must request a refund through the official form available at [mallorcalivefestival.com/cashless] from June 18 at 10:00 AM to July 15 at 11:59 PM. The refund of the remaining balance will be processed solely via bank transfer and through the cashless provider.
Any balance not requested within the specified period will be considered abandoned, with no possibility of subsequent claims.
6.24. The user is informed that the cashless system allows loading the exact amount desired for consumption, including non-rounded amounts, enabling the full use of the wristband balance without additional costs.
6.25. Promotional amounts, free top-ups, or bonus balances provided by the promoter as a courtesy or part of promotions will not be refunded.
Copyright and other intellectual property rights.
6.26. All texts, drawings, photographs, footage, images, data, databases, software, names, trademarks, logos, and other elements of the Service are protected by intellectual property rights and belong to the organization or third parties.
6.27. All databases on the Website are subject to database protection law, both in structure and content.
6.28. The organization, its logo, graphics, button icons, scripts, and service names are trademarks or trade names. They may not be used in connection with other products or services that are not from the organization, in any way that may cause confusion or in any manner that denigrates or discredits the organization. Other trademarks not owned by the organization that appear or may appear on the Website are the property of their respective owners, who do not necessarily have to be affiliated, connected, or sponsored by the organization.
6.29. It is strictly prohibited to store, reproduce, modify, advertise, distribute, transmit, or sell information and content provided on or through the Website.
Limitation of liability.
6.30. The user acknowledges and accepts that the organization cannot and will not be responsible for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of revenue, goodwill, use, data, or other intangible losses (even if the organization has been warned of the possibility of such losses) resulting from:
- Malfunction, interruptions, or errors in electronic transmissions of services or information through the Website.
- Viruses that could, despite precautions taken, occur on the Website.
- Errors or negligence committed by employees.
- Fraudulent falsification of data by third parties due to unauthorized intrusion into the Website.
- Actions or conduct of third parties on the Website.
- Inability to use the Service.
- Unauthorized alteration, access, and processing of user data.
For the use of RFID chips and their corresponding technology (including technical support), the organization will contract a specialized cashless service provider.
CLAUSE 7. RIGHTS RESERVED BY THE ORGANIZER.
7.1. Violation of any of the rules and regulations described herein or any action by the user that may cause harm, damage, or grievance to the organizer or other users will entitle the event organizer to immediate expulsion from the venue.
In general, if the user leaves the venue, re-entry will be denied unless a new ticket is purchased. In any case, the organizer reserves the right to allow a second entry in justified cases.
7.2. Provided it is due to justified reasons or disputes arising from relations with the artists themselves, insurmountable for the organizer, the organization reserves the right to alter or modify the program and/or the date and time of the event.
7.3. Any claim based on reasons for alteration or cancellation of the event must be addressed to the organization along with the ticket receipt.
7.4. In the event that the organization rejects a claim directly submitted by a user, the user may directly resort to a notified alternative dispute resolution entity for this type of consumer disputes, in accordance with the provisions of the law incorporating Directive 2013/11/EU of the European Parliament and of the Council of May 21, 2013, into Spanish law.
7.5. For these purposes, the user is provided access to such entities through the link to the European Union’s online dispute resolution platform: Online Dispute Resolution | European Commission.
7.6. For safety reasons, in cases of force majeure, the organizer reserves the right to fully or partially evacuate the venue, interrupt or stop the event’s progress, and even keep users in the venue after the event has ended until the cause is resolved or safety is restored.
CLAUSE 8. PERSONAL DATA.
8.1. The online sale of tickets and any other product and/or service of the event involves the provision of personal and, in some cases, banking information.
8.2. The event organizer guarantees that the provision of this data is carried out in a secure environment. However, considering that no security system is infallible, it is not possible to guarantee that such security measures are free from errors or immune to interference from third parties (hackers, among others). For this precise reason, the event organizer is exempt from any liability for any damages and/or losses that may arise due to causes beyond the control of the Festival and its organization.
8.3. Users are warned that they have a duty to provide accurate, precise, true, up-to-date, and legitimate personal data, and the organizer assumes no responsibility for the provision of any incorrect, false, or erroneous data.
CLAUSE 9. IMAGE RIGHTS.
9.1. The event organizer holds all intellectual and industrial property rights to the artistic performances or acts carried out during the event, without temporal or territorial limitation, and with no restrictions other than those provided by law.
9.2. Therefore, the publication or dissemination for commercial or advertising purposes of any recordings of images or sounds of the performances that take place during the event is prohibited. Only capturing images or recordings for exclusive private and personal use will be permitted.
9.3. For the purposes of Organic Law 1/1982, of May 5, on civil protection of the right to honor, personal and family privacy, and one’s own image, attendees are informed that their attendance at the festival implies express consent and authorization for the capture, reproduction, distribution, and publication of their image, including for advertising purposes and through any medium, including electronic media.
9.4. The user acknowledges and accepts that their image may be captured during the event through photographs, footage, recordings, or any other record of image, voice, and/or name, expressly authorizing the organizer to record, store, disseminate, use, and exploit such images, either directly or through third parties, provided it is for marketing and advertising purposes or in compliance with an order from a competent authority to ensure the event’s safety.
9.5. For these purposes, the authorization granted to the organizer to disseminate their images under the terms described above is made freely, fully, without temporal limitation, and free of charge.
9.6. The capture of the image, in any of the forms described, will also allow editing, transfer, deletion, and any other changes, including recordings, footage, photographs, phonograms, and texts.
9.7. The event organizer is not responsible in any case for promotional actions involving the use of attendees’ images and voices by third-party sponsoring or collaborating companies, with the latter being solely responsible for all purposes.
9.8. The event organizer reserves the right to assign these rights to companies within its same group for the purposes set forth herein.
CLAUSE 10. MINORS.
10.1. The entry of minors to the Festival will be governed by current regulations and, in particular, by the provisions of Law 7/2013, of November 26, on the legal regime for the installation, access, and exercise of activities in the Balearic Islands, in accordance with the interpretation provided in Consultation 2017-21-A of the Balearic Islands Government Council. For these purposes:
10.2. In general, minors are allowed access to the venue with the following particulars:
- Minors aged between 14 and 16, inclusive, may only enter the event duly accompanied by the holder of parental authority (father or mother), legal guardian, or an adult duly identified and authorized by the parents or guardians, who must ensure their physical or moral integrity at all times.
- Minors aged 16 and over may access the venue with a duly signed authorization from their parents or guardians, which must be presented at the event entrance by the holder of parental authority (father or mother), legal guardian, or an adult duly identified and authorized by the parents or guardians.
10.2. All access authorization forms for parents, mothers, and legal guardians are available on the Festival’s website.
10.3. During their stay at the venue, parents, legal guardians, or duly identified adults will be solely responsible for the minors under their care and for any actions they undertake. For these purposes, at the time of entry to the venue, it will be necessary to present the following documentation: ID, family book, or birth certificate if the former is not available, passport, or any other document proving the parental or guardianship relationship with the minor. Each adult will be responsible for a maximum of three minors.
10.3. Children up to 5 years of age will have free access to the event but must acquire a zero-cost ticket (€0). From the age of six to eleven, inclusive, they will receive a 25% discount on the full general ticket price, with the sale of VIP or PREMIUM tickets to these minors being prohibited.
CLAUSE 11. APPLICABLE LAW AND JURISDICTION.
11.1. These terms and conditions are governed exclusively by Spanish law.
11.2. For the resolution of any dispute, the parties expressly submit to the Courts and Tribunals of Palma de Mallorca, as it is the place of fulfillment of the obligation.
